Mahkamah Konstitusi (MK) mengabulkan seluruh uji materiil Undang-Undang Nomor 4 Tahun 2016 tentang Tabungan Perumahan Rakyat (Tapera). Putusan ini berkaitan dengan permohonan nomor 96/PUU-XXII/2024. Menurut MK UU Tapera bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia tahun 1945 dan tidak mempunyai kekuatan hukum mengikat sepanjang tidak dilakukan penataan.

Dalam putusannya yang dibacakan secara terbuka untuk umum, mahkamah meminta agar dilakukan penataan ulang terkait UU Tapera maksimal dalam dua tahun setelah putusan dibacakan.  Hakim Konstitusi Enny Nurbaningsih menjelaskan, masa transisi dua tahun sebagaimana putusan MK ini diserahkan pada BP Tapera. 

Menurut Enny, dalam waktu dua tahun ke depan, UU Tapera masih digunakan usai putusan ini,. MK juga mendorong perumusan perubahan UU Tapera sesuai dengan esensi yang tercantum dalam amanat undang-undang. 

“Dalam proses transisi tersebut BP Tapera dapat menentukan/mengatur transisi setelah putusan. Demikian juga terkait dengan iuran,” kata Enny kepada awak media lewat pesan singkat pada Senin (29/9) sebagaimana dikutip dari di Katadata.co.id dengan judul “MK Putuskan UU Tapera Bertentangan dengan Konstitusi, Iuran jadi Tak Wajib?
