Apa yang terjadi di laut Tangerang, Banten?

Adanya pemufakatan jahat dilakukan oleh kelompok pengusaha dan pejabat yang berwenang pada wilayah perairan laut dengan mengurung/memasang pagar di laut lepas pantai.

Bagaimana cara mereka melakukan?

Dengan pekerjaan kontruksi di atas air, menggunakan tongkang konstruksi dipandu kapal menumbukkan bambu dengan alat drop hummer/memukul tiang ke dasar laut menembus lumpur/pasir/batu sekalipun menjadi pagar sepanjang lebih dari 30 km.

Merubah wilayah laut menjadi tanah darat untuk dikomersilkan

Apa dampaknya

 1. Hilangnya dan berhentinya beberapa asset garis pantai, wilayah laut lepas pantai, kegiatan pertanian, peternakan dan asset-asset negara lainnya seperti, irigasi, jalan, sungai, jembatan dan bangunan dll.

2. Jika pagar laut tersebut tidak dibongkar pantai terisolasi dan ketika pagar tersebut hancur akan menjadi tunggul yang membahayakan/ranjau laut bagi perairan pantai sepanjang 30 km

Peraturan atau Undang-Undang yang dilanggar

– Undang-Undang Nomor 1 Tahun 2014 Tentang Pengelolaan Wilayah Pesisir dan Pulau- Pulau Kecil. Pada Pasal 75, Setiap Orang yang memanfaatkan ruang dari sebagian Perairan Pesisir dan pemanfaatan sebagian pulau-pulau kecil yang tidak memiliki Izin Lokasi sebagaimana dimaksud dalam Pasal 16 ayat (1) dipidana dengan pidana penjara paling lama 3 (tiga) tahun dan denda paling banyak Rp500.000.000,00 (lima ratus juta rupiah)

– Undang-Udang Nomor 32 Tahun 2014 Tentang Kelautan, Pada Pasal 49, Setiap orang yang melakukan pemanfaatan ruang Laut secara menetap yang tidak memiliki izin lokasi sebagaimana dimaksud dalam Pasal 47 ayat (1) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan pidana denda paling banyak Rp20.000.000.000,00 (dua puluh miliar rupiah).

Proses hukum apa yang dilakukan saat ini.

Proses sidang di Pengadilan Negeri Serang Arsin, (Kepala Desa Kohod, Kecamatan Paku Haji, yang adalah salah satu dari lebih dari seratus kepala desa di sembilan kecamatan di pantai utara Banten) dan kawan-kawan yang didakwa Pasal 12 huruf b dan atau Pasal 5 ayat (2) dan atau Pasal 9 jo Pasal 18 ayat (1) huruf b, Undang-Undang Nomor 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi.

Apakah proses hukum ini menyelesaikan perkara pagar laut?

Pekerjaan pagar laut adalah pekerjaan kontruksi besar dan wilayah yang luas meskipun Arsin dan kawan-kawan diputus bersalah dan diwajibkan mencabut pagar yang dibuat, dipastikan tidak akan bisa membongkar pagar laut tersebut.

Proses hukum apa yang harus dijalankan?

Kepolisian mencari pelaku pemasang pagar laut sebenarnya atau menindaklanjuti Pengaduan Masyarakat (Dumas) LBH AP PP Muhammadiyah di Bareskrim POLRI pada tanggal, 17 Januari 2025, dalam pengaduannya menyebut nama-nama orang dan perusahaan diduga pelaku pemasangan pagar laut tersebut.
