JAKARTA — Pengalihan penanganan perkara mantan Jampitsus Febrie Adriansyah dari kepolisian ke Kejaksaan Agung (Kejagung) dinilai menjadi puncak gunung es dari pembusukan institusi penegak hukum di Indonesia. Momentum ini sekaligus menelanjangi krisis independensi akut yang dialami Komisi Pemberantasan Korupsi (KPK) saat ini.
Dalam tayangan di kanal Abraham Samad SPEAK UP, advokat senior Petrus Celestinus, S.H., menuding tata kelola penegakan hukum nasional telah bergeser menjadi urusan privat antarelite lembaga, mengabaikan mandat konstitusi demi stabilitas politik masing-masing.
KPK yang Kehilangan Taji dan Rendah Diri
Sorotan tajam diarahkan kepada KPK yang memilih bersikap pasif dan hanya memosisikan diri sebagai “tim supervisi” dalam skandal besar ini. Padahal, secara normatif, Pasal 10A UU KPK memberikan kewenangan absolut bagi lembaga antirasuah tersebut untuk mengambil alih (backside superpower) perkara korupsi yang mandek, bertele-tele, atau diduga melibatkan internal aparat penegak hukum.
Petrus menilai, sikap pasif ini merupakan dampak langsung dari revisi UU KPK pada 2019 yang secara sistematis merusak mentalitas dan independensi lembaga.
“Akibat dari revisi UU KPK ini, secara mental dan struktur organisasi, KPK menjadi lembaga yang merasa rendah diri (inferiority complex). Kedikdayaan mereka sudah hilang. Bahkan, derajatnya kini seperti berada di bawah kepolisian sektor (Polsek), merasa kecil melihat kekuasaan Polri dan Kejagung yang semakin besar,” ujar Petrus di hadapan mantan Ketua KPK, Dr. Abraham Samad.
Krisis ini diperparah oleh konflik loyalitas di internal KPK, di mana para penyidik yang berasal dari instansi induk (Polri dan Kejaksaan) disinyalir lebih patuh pada instruksi Kapolri atau Jaksa Agung ketimbang kepemimpinan pimpinan KPK sendiri.
Mandulnya Pengawasan Legislatif
Pembusukan institusi ini diperparah oleh sikap Komisi III DPR RI yang dinilai ikut “cawe-cawe” sebagai pemadam kebakaran politik, alih-alih menjalankan fungsi pengawasan (check and balances). Kehadiran legislatif dalam konferensi pers bersama aparat dinilai publik sebagai langkah mengunci perkara agar tidak melebar.
Petrus menyayangkan sikap Komisi III yang justru menunjukkan kedekatan personal antarelite untuk menyelesaikan urusan hukum yang krusial bagi publik. Hubungan yang terlalu mesra ini membuat fungsi kontrol legislatif mandul. Setiap rapat kerja lebih sering diisi dengan puja-puji kepada pimpinan institusi hukum, sementara jeritan masyarakat yang mencari keadilan diabaikan.
Jejaring yang terpusat di ranah politik dan penegakan hukum ini dinilai kian mengukuhkan cengkeraman mafia peradilan, membuat penuntasan kasus korupsi kakap berakhir pada kompromi meja makan, bukan di ruang sidang yang transparan.
