JAKARTA — Kejanggalan di balik penanganan status hukum mantan Jaksa Agung Muda Tindak Pidana Khusus (Jampitsus), Febrie Adriansyah, kian memicu sorotan tajam. Proses hukum yang semula dinilai agresif kini dicurigai penuh kompromi pasca-pengalihan perkara dari Korps Pemberantasan Tindak Pidana Korupsi (Kortas Tipikor) Polri ke Kejaksaan Agung (Kejagung).
Advokat senior Petrus Selestinus, S.H., membedah sejumlah kejanggalan kronologis yang dinilai di luar nalar hukum acara pidana (KUHAP). Rangkaian kejanggalan tersebut merusak transparansi dan memicu tanda tanya besar di tengah publik.
Kronologi Kilat Tanpa Pemeriksaan Formil
Kejanggalan pertama terletak pada lompatan proses yang dinilai tidak wajar. Kortas Tipikor Polri bergerak cepat melakukan penggeledahan masif di sejumlah aset di kawasan Sentul dan Cipete, yang berujung pada temuan barang bukti mencengangkan senilai Rp510 miliar dan puluhan kilogram emas.
Keesokan harinya, status Febrie langsung dinaikkan menjadi tersangka. Namun, Petrus menyoroti tidak adanya transparansi mengenai kapan proses penyelidikan formal dilakukan. Bahkan hingga perkara dialihkan, publik tidak pernah mendapatkan informasi mengenai adanya pemeriksaan formal terhadap Febrie, baik sebagai saksi maupun tersangka.
“Ini bukan perkara Operasi Tangkap Tangan (OTT). Dalam hukum acara, penetapan tersangka yang sah minimal didahului pemeriksaan calon tersangka dan alat bukti yang solid. Mengapa setelah digeledah dan dinyatakan tersangka, justru tidak ada pemanggilan, penangkapan, atau penahanan?” kritik Petrus tajam dalam kanal Abraham Samad SPEAK UP.
Alibi Pasca-Fakta (Post-Factum) dan Ancaman Praperadilan
Ketidakjelasan status hukum Febrie pasca-perkaranya diserahkan ke Kejagung memicu kekhawatiran baru. Secara hukum, penyerahan kasus ini dinilai unprosedural karena berkas perkara belum dinyatakan lengkap (P21).
Petrus mengendus adanya jeda waktu yang sengaja diciptakan untuk mematangkan skenario penyelamatan di balik layar. Dengan posisi Febrie yang belum ditahan, terbuka celah untuk menciptakan dokumen hukum pasca-fakta (post-factum) atau alibi tertulis guna mengaburkan kepemilikan aset-aset mewah yang disita.
Lebih jauh, cacat prosedur dalam penetapan tersangka tanpa pemeriksaan formal ini dinilai menjadi “karpet merah” bagi Febrie untuk membatalkan status hukumnya.
“Status tersangka ini sangat rawan digugat dan dibatalkan melalui jalur praperadilan karena penyidik menabrak hukum acara. Jika skenario ini yang terjadi, maka proses hukum kemarin bukan untuk menuntaskan perkara, melainkan wujud perselingkuhan antar-institusi untuk mengubur kasus secara legal,” pungkas Petrus.
