Publik tercengang, mendengar kabar tanah milik Wakil Presiden ke-10 dan ke-12 RI, Jusuf Kalla (JK) seluas 16,4 hektare di Jalan Metro Tanjung, Kecamatan Tamalate, Makassar, Sulawesi Selatan (Sulsel), diserobot pihak lainnya. JK menyebut hal itu sebagai peristiwa perampokan tanah miliknya. (Rabu, 5/11).

Jusuf Kalla merasa geram karena menduga ada rekayasa sertifikat yang melibatkan pihak pengembang PT Gowa Makassar Tourism Development (GMTD), anak usaha yang terafiliasi dengan Lippo Group. Lebih lanjut, JK menyatakan jika dirinya saja yang mantan Wakil Presiden diperlakukan demikian, apalagi rakyat biasa.

Sebenarnya, sudah terlalu banyak rakyat Indonesia yang menjadi korban perampasan tanah oleh oligarki property. Penulis, di tim Advokasi konsisten menggunakan bahasa ‘perampasan tanah’, bukan sengketa tanah, karena aktivitas mereka melakukan pengambilan tanah tanpa hak dan tanpa keridloan pemiliknya.

Seperti yang dialami oleh klien penulis, Charlie Chandra yang sudah memiliki tanah dari orang tuanya, tiba-tiba dirampas oleh oligarki properti PIK-2. Juga apa yang dialami oleh pasangan suami istri Supardi Kendi Budiarjo dan istrinya, Nurlela.

Bahkan, pasangan suami istri ini bukan hanya harus kehilangan tanahnya yang kini disulap menjadi kawasan The Golf Lake Residence oleh Agung Sedayu Group melalui PT Sedayu Sejahtera Abadi (PT SSA). Keduanya, juga harus mendekam dipenjara dengan vonis 2 tahun, melalui Kriminaliasi yang dilakukan oleh Nono Sampono, direktur PT SSA.

Modus operandi perampasan tanah dalam kasus Jusuf Kalla, Charlie Chandra hingga SK Budiardjo & Nurlela secara umum sama. Oligarki property selalu memposisikan diri seolah-olah sebagai pembeli beritikad baik.

Secara hukum, perampasan tanah itu dilakukan oleh pihak lainnya, baru kemudian pemilik dan pengelola akhir tanah adalah Oligarki property. Lalu, mereka menggunakan legitimasi putusan pengadilan untuk melegalisasi perampasan tanah yang dilakukan.

Di kasus Jusuf Kalla, oligarki property menggunakan sosok Haji Namiah, di kasus Charlie Chandra menggunakan sosok ahli waris The Pit Nio, di kasus SK Budiardjo & Nurlela menggunakan peran PT Bangun Marga Jaya (PT BMJ). Artinya, ada proses ‘Cuci Hak’ kepemilikan tanah, sebelum akhirnya tanah itu dikuasi oleh oligarki.

Lippo Group melalui PT Gowa Makassar Tourism Development (GMTD), bisa cuci tangan dengan menyatakan pembeli yang beritikad baik, dengan dalih telah membeli tanah dari Haji Namiah. Padahal, aktualnya merampas tanah dari Jusuf Kalla.

Oligarki PIK-2 melalui PT MBM cuci tangan dengan menyatakan sebagai pembeli yang beritikad baik, dengan dalih telah membeli tanah dari ahli waris The Pit Nio. Padahal, aktualnya merampas tanah dari keluarga Charlie Chandra.

Agung Sedayu Group melalui PT SSA cuci tangan dengan menyatakan sebagai pembeli yang beritikad baik, dengan dalih telah membeli tanah dari PT MBM. Padahal, aktualnya merampas tanah dari SK Budiardjo & Nurlela.

Selain menggunakan peran pihak lain, proses perampasan tanah ini dilegalisasi oleh BPN dan Pengadilan. Sementara aparat penegak hukum baik dari institusi Kepolisian dan Kejaksaan, mengawal dan membackup penuh perampasan tanah oleh oligarki ini.

Itulah yang terjadi di Republik ini. Jadi, bukan hanya Jusuf Kalla yang menjadi korban. Bahkan, SK Budiardjo melalui Organisasi FKMTI (Forum Korban Mafia Tanah Indonesia) mencatat sudah ada ratusan hingga ribuan rakyat yang menjadi korban perampasan oleh mafia tanah.
