JAKARTA – Mantan Wakil Kepala Kepolisian RI (Wakapolri), Komjen (Purn.) Oegroseno, memberikan catatan kritis terkait wacana penyelesaian sengketa informasi ijazah Presiden Joko Widodo melalui mekanisme Restorative Justice (RJ). Dalam keterangannya di kanal YouTube Abraham Samad, Oegroseno menegaskan bahwa mekanisme damai tersebut tidak tepat digunakan untuk kasus yang menyangkut kebenaran dokumen publik.

Salah Kaprah Restorative Justice

Oegroseno menilai institusi Polri saat ini cenderung menyalahartikan filosofi Restorative Justice. Menurutnya, RJ diciptakan untuk menyelesaikan perkara pidana ringan atau perselisihan antarwarga yang bersifat privat, bukan untuk menentukan keaslian dokumen negara yang menjadi perhatian luas.

‘’Kalau restoraktive justice  ini atas permintaan siapa? Permintaan Pak Jokowi bisa juga ditolak. Atas permintaan Roy Suryo, Pak Rismon, bisa juga Pak Jokowi menolak,’’ ujarnya mengaku wacara RJ ini sangat dilematis dan sulit dilaksanakan. Masalah ijazah ini adalah masalah pembuktian materiil, asli atau palsu yang tidak bisa diselesaikan cukup dengan dengan  bersalaman atau saling memaafkan.

‘’kalau Jokowi menyatakan, bisa menjawab pertanyaan pertanyaan tadi, iya kalau itu benar-benar asli, selesai.  Tapi kalau ternyata tidak? Inikan jadi masalah baru nih. Iya khan,’’ ujar Oegro.

Oegro menambahkan baik kasus Jokowi di Bareskrim mapun Roy Suryo dkk di Polda harusnya dilanjutkan. Di Bereskrim silahkan disidik sampai P21.

‘’Silahkan Jaksa kalau mau menerbitkan deponerin dengan alasan sebagai mantan Presiden. Tapi sudah terbukti,’’ ujarnya.   Begitupun dengan kasus Roy Suryo dkk silahkan saja lanjut, proses persidangannya tapi jangan ada penahanan. Kasusnya 310 dan 311 saja. Jangan ditambah-tambah pasal.

‘’Jangan ada penahanan, silahkan lanjut sampai persidangan. semua dibuktikan di sana,’’ jelasnya.

Sebagai tokoh senior di korps kepolisian, Oegroseno mengingatkan bahwa fungsi utama Polri adalah memberikan kepastian hukum. Ia mendorong agar Bareskrim Polri mengedepankan Scientific Crime Investigation daripada sekadar mediasi politik.

    I was just presented with a link that took me to Yahoo to login, which didn’t work. I was never given the choice to agree to Yahoo terms, or create a new password on Yahoo. Just because Comcast made errors in their rollout shouldn’t cause us customers to be stuck with yahoo email. I want to change back to Xfinity/Comcast email platform that worked perfect.
