JAKARTA – Di tengah kecamuk perang Selat Hormuz, sebuah ancaman sunyi namun mematikan mulai menghantui para pemimpin Amerika Serikat dan Israel. Wartawan senior Pitan Daslani menilai bahwa keputusan Mahkamah Kejahatan Internasional (ICC) telah menciptakan realitas baru di mana kekuasaan politik tidak lagi mampu memberikan jaminan keamanan absolut dari jeratan hukum global.

Putusan ICC: Bukan Sekadar Gertakan

Pitan menjelaskan bahwa ICC, meskipun bukan organ langsung di bawah PBB, bertindak sebagai lembaga independen yang memiliki kekuatan untuk mengeluarkan Red Notice atau perintah penangkapan internasional. Ia menyoroti bahwa surat perintah penangkapan terhadap tokoh-tokoh seperti Benjamin Netanyahu bukan lagi sekadar wacana diplomatik, melainkan instrumen hukum yang sudah mulai diaktifkan.

‘Penjara’ Tanpa Jeruji Besi

Menurut Pitan, tantangan terbesar bagi pemimpin seperti Donald Trump dan Netanyahu adalah hilangnya kebebasan bergerak mereka di masa depan. Meskipun AS dan Israel bukan merupakan negara anggota (State Party) yang menandatangani Statuta Roma, mereka tetap akan terisolasi secara geografis.

“Trump dan Netanyahu mungkin merasa aman selama berada di negaranya sendiri atau di bawah pengawalan ketat kepresidenan. Namun, mereka lupa bahwa kekuasaan itu tidak abadi,” tegas Pitan. Begitu mereka tidak lagi menjabat, ruang gerak mereka akan menyempit hanya di wilayah domestik karena risiko penangkapan di negara-negara penandatangan Statuta Roma.

Nasib Seperti Rodrigo Duterte

Pitan memberikan komparasi tajam dengan mantan Presiden Filipina, Rodrigo Duterte. Ia mengingatkan bahwa ketika seorang pemimpin sudah kehilangan tameng kekuasaannya, institusi hukum internasional akan mulai bergerak dengan efektif.

“Saat pengawalan melekat berkurang di hari tua, itulah saat mereka menjadi sangat rentan. Mereka akan terpenjara di dalam lingkungannya sendiri, tidak bisa ke mana-mana karena jika mereka menginjakkan kaki di negara seperti Hungaria, Korea Selatan, atau Afrika Selatan, mereka pasti akan ditangkap,” tambahnya.

Sikap Tegas Hungaria: Sinyal Keretakan Eropa

Salah satu poin penting yang diangkat Pitan adalah pernyataan tegas Perdana Menteri Hungaria, Viktor Orban. Secara mengejutkan, Orban menyatakan kesiapannya untuk menangkap Netanyahu jika yang bersangkutan memasuki wilayah negaranya.

Bagi Pitan, ini adalah sinyal bahwa negara-negara Eropa mulai mengambil jarak dari kebijakan Amerika dan Israel. “Ketika sekutu di Eropa mulai berbicara tentang penegakan hukum ICC secara kaku, itu artinya perlindungan diplomatik yang selama ini dinikmati AS dan Israel sudah mulai rontok,” jelas Pitan.

Pitan Daslani menyimpulkan bahwa dunia sedang bergerak menuju era di mana tidak ada lagi pemimpin yang benar-benar kebal hukum. Isu ICC di tengah konflik Iran ini menjadi pengingat keras bahwa sejarah akan mencatat setiap kebijakan perang, dan pengadilan internasional siap menunggu di ujung masa jabatan mereka.
